Terms of Service

Last updated: August 26, 2026

1. Service Description

ThemeSweep ("the Service") is a Shopify application operated by JMS Dev Lab that scans Shopify theme files to identify potential leftover app code, unused static references, and orphan candidates. The Service provides evidence, confidence levels, reporting, backup, and merchant-approved cleanup for Shopify store themes. Static analysis cannot prove that an app is uninstalled or that every flagged item is unused.

2. Account Terms

  • You must be the owner or an authorized administrator of a Shopify store to use ThemeSweep.
  • You are responsible for maintaining the security of your Shopify account and for all activity that occurs through ThemeSweep on your store.
  • Shopify provides the store identity during installation. ThemeSweep accesses your store only after you approve the Shopify authorization flow.
  • One ThemeSweep installation and subscription applies to one Shopify store.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of Shopify's Terms of Service
  • Attempt to reverse-engineer, decompile, or extract the source code of ThemeSweep
  • Circumvent usage limits, rate limits, or billing restrictions
  • Share your Shopify account access or API credentials with unauthorized third parties
  • Use automated tools to abuse or overload the Service beyond normal usage patterns

4. Free Trial and Billing

  • Free trial: New stores receive a 14-day free trial with diagnostic scanning and cleanup access. No credit card is required to start the trial.
  • After the trial: Your store falls back to the Free plan, which provides unlimited diagnostic scans and one cleanup of a single reviewed finding. Starter at $9.99/month, Pro at $19.99/month, and Agency at $39.99/month unlock the features shown on Shopify's managed pricing page.
  • Billing: All billing is handled through the Shopify Billing API. Charges appear on your regular Shopify invoice.
  • Plan changes: You may upgrade or downgrade your plan at any time. Changes take effect according to the timing and charge details Shopify displays before you approve the change.
  • Refunds: As billing is managed by Shopify, refund requests are subject to Shopify's billing policies. Contact us for billing disputes.

5. Theme Modifications and Merchant Responsibility

ThemeSweep modifies your Shopify theme files as part of its core cleanup functionality. By using the Service, you acknowledge and agree that:

  • You authorize modifications: When you initiate a cleanup operation, you are authorizing ThemeSweep to modify, remove, or comment out code in your theme files.
  • Review before applying: You are responsible for reviewing scan results and detection reports before initiating any cleanup. ThemeSweep provides confidence scores and details to help you make informed decisions.
  • Merchant accepts responsibility: ThemeSweep uses risk controls including backups, confidence scoring, revalidation, and dependency checks, but automated analysis is not infallible. You accept responsibility for approving changes applied to your store's theme.
  • Test before publishing: Cleanup changes are applied to a duplicate/unpublished theme. You should preview and test the modified theme before publishing it to your live store.

6. Backups and Rollback

  • ThemeSweep automatically creates a backup of affected theme files before any cleanup operation.
  • Backups expire after 30 days. After this period, backup data is permanently deleted and cannot be recovered.
  • You may restore your theme from a backup at any time within the 30-day retention window using the ThemeSweep dashboard.
  • It is your responsibility to maintain your own independent theme backups if you require longer retention.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

  • ThemeSweep is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • JMS Dev Lab shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, profits, data, or business opportunities arising from your use of the Service.
  • Our total liability for any claim related to the Service shall not exceed the amount you paid for ThemeSweep in the 12 months preceding the claim.
  • We are not liable for any damages resulting from theme modifications that you approved and applied to your store, including any impact on store functionality, appearance, or performance.

8. Termination

  • You may terminate your use of ThemeSweep at any time by uninstalling the app from your Shopify admin panel.
  • We may suspend or terminate your access to the Service if you violate these Terms, abuse the Service, or fail to pay applicable subscription fees.
  • Upon termination, all your data (including store information, scan results, and backups) will be permanently deleted within 30 days.
  • Sections regarding limitation of liability, indemnification, and dispute resolution survive termination.

9. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of material changes by updating the "Last updated" date on this page. If we make significant changes that affect your rights, we will provide additional notice (such as an in-app notification or email). Your continued use of ThemeSweep after changes are posted constitutes acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and if necessary, binding arbitration.
